Vacation Rentals Tucson Rental Agreement - Policies and Procedures

WE, THE RENTERS, AGREE TO THE FOLLOWING:

PAYMENT POLICY
A damage/reservation deposit of $200.00 is required. This must be received within 72 hours of booking the reservation along with booking fee and any other applicable fees (ie cleaning).  An advance payment equal to 50% (fifty percent) of the rental rate is required 60 days before arrival.  The advance payment will be applied toward the rent.  The advance payment is not a damage deposit.  The BALANCE OF RENT is due 30 (thirty) days before your arrival date.  During peak seasons full payments may be required up to 90 days in advance to secure times.

CANCELLATIONS
A 60 (sixty) day notice is required for cancellation. Cancellations that are made 60 (sixty) days or more in advance of the scheduled check-in dated will receive a refund of deposit less the booking fee ($25) and a cancellation fee ($150).  Cancellations made within sixty (60) days of check-in date will not receive any refund. Changes that result in a shortened stay, that are made within 60 days of the arrival date, will not result in any prorating, refunds, or reduction of rents.  Early departure does not warrant any refund of rent or deposit. 

MONTHLY RESERVATION CANCELLATIONS
Monthly renters must cancel 120 (one-hundred and twenty) days prior to check-in.  Monthly renters who make a change that results in a shortened stay must be made at least 90 (ninety) days prior to check-in.

MAXIMUM OCCUPANCY
The maximum number of guests at the rental property is limited to a maximum of 6 (six) adults.  Additional arrangements may be made in writing for additional guests and additional fees may apply.

CHECK-IN
After 4 p.m. local time – No early check-Ins

CHECK-OUT
10 a.m. local time

ANIMALS
All pets must be pre-approved with owner! Additional pet rent will be required.

SMOKING
There is NO smoking allowed at any time.  This is a NO smoking property!

DAMAGE DEPOSIT
The deposit automatically converts to a security / damage deposit upon arrival.  The deposit is NOT applied toward rent; however, it is fully refundable within 14 (fourteen) days of departure, provided the following provisions are met:
1.No damage is done to the house or its contents, beyond normal wear and tear.
2.No charges are incurred due to contraband, pets, or collection of rents or services rendered during the stay.
3.All debris, rubbish, and discards are placed in dumpster, and soiled dishes are placed in the dishwasher and cleaned.  One load of laundry is started.
4.All keys are left on the kitchen table and the house is left locked.
5.All charges accrued during the stay are paid prior to departure.
6.No linens lost or damaged
7.Parking passes, garage door opener, gated entrance opener left on kitchen table upon departure.
8.Property is left in same condition as was delivered

INCLUSIVE FEES
Rates include a one-time linen/towel set-up.  Amenity fees are included in the rental rate.

NO DAILY MAID SERVICE
While linens and bath towels are included in the unit, daily maid service is not included in the rental rate.  We supply swimming/beach towels for the community pool.  We do not permit bath towels or linens to be taken from the property.

RATE CHANGES 
Rates for other reservations are subject to change.

FALSIFIED RESERVATIONS
Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check-in.

WRITTEN EXCEPTIONS
Any exceptions to this entire rule agreement must be approved in writing in advance.

PARKING PASSES AND GARAGE DOOR OPENERS
Parking passes and garage door openers (if they apply to this property) will be located inside the property.  Renters must display parking (guest) pass on the rear-view mirror at all times.  Failure to display may result in towing of vehicle at renter's expense.  Leave parking passes and garage door openers on kitchen table of property upon departure.

PRIVATE GATED COMMUNITY
If rental property is located in a private gated community.  Renter must adhere to all gated community rules and etiquette.  This includes peaceful and quiet domain.  NO LOUD BOISTEROUS PARTIES.

GOLF COURSE
Golf course green fees and associated charges are not included in any rental rates.  Renters and guests are required to secure all golf play at renters convenience and associated costs. 

USE OF PREMISES
The Premises shall be used and occupied by Tenant and Tenant's immediate family, and guests.  The number of occupants shall not exceed the amount stipulated in the “rental policies & rules”.  The premises shall not be used at any time during the term of this Agreement by Tenant for the purpose of carrying on any business, profession, or trade of any kind, or for any purpose other than as a private single family dwelling.  Tenant shall not allow any other person, other than Tenant's immediate family or transient relatives and friends who are guests of Tenant, to use or occupy the Premises without first obtaining Landlord's written consent to such use.   Tenant shall comply with any and all laws, ordinances, rules and orders of any and all governmental or quasi-governmental authorities affecting the cleanliness, use, occupancy and preservation of the Premises. tenant shall not assign this Agreement, or sub-let or grant any license to use the Premises or any part thereof An assignment, sub-letting or license without the prior written consent of Landlord or an assignment or sub-letting by operation of law shall be absolutely null and void and shall, at Landlord's option, terminate this Agreement.

ALTERATIONS AND IMPROVEMENTS
Tenant shall make no alterations to the buildings or improvements on the Premises or construct any building or make any other improvements on the Premises.  Any and all alterations, changes, and/or improvements built, constructed or placed on the Premises by Tenant shall, be and become the property of Landlord and remain on the Premises at the expiration or earlier termination of this Agreement.

HAZARDOUS MATERIALS
Tenant shall not keep on the Premises any item of a dangerous, flammable or explosive character that might unreasonably increase the danger of fire or explosion on the Premises or that might be considered hazardous or extra hazardous by any responsible insurance company. 

UTILITIES
Landlord will provide utilities in rental fees to include and limited to – Electric, City Water, Cable TV, Qwest Local phone.  Electric bills will have a maximum usage rate of $300.00 monthly, however, if electric bills due exceed $300.00 tenant will be responsible for amount in excess of $300.00, which will be deducted fromm security deposit unless tenant makes up outstanding balance in addition to monthly rents.

MAINTENANCE & RULES
Tenant will, at its sole expense, keep and maintain the Premises and appurtenances in good and sanitary condition and repair during the term of this Agreement and any renewal thereof.  Without limiting the generality of the foregoing, Tenant shall
1.Not obstruct the driveways, sidewalks, courts, entry ways, stairs and/or halls, which shall be used for the purposes of ingress and egress only
2.Keep all windows, glass, window coverings, doors, locks and hardware in good, clean order and repair
3.Not obstruct or cover the windows or doors
4.Not leave windows or doors in an open position during any inclement weather
5.Not hang any laundry, clothing, sheets, etc.  from any window, rail, porch or balcony nor air or dry any of same within any yard area or space
6.Not cause or permit any locks or hooks to be placed upon any door or window without the prior written consent of Landlord
7.Keep all air conditioning filters clean and free from dirt
8.Keep all lavatories, sinks, toilets, and all other water and plumbing apparatus in good order and repair and shall use same only for the purposes for which they were constructed.  Tenant shall not allow any sweepings, rubbish, sand, rags, ashes or other substances to be thrown or deposited therein.  Any damage to any such apparatus and the cost of clearing stopped plumbing resulting from misuse shall be borne by Tenant
9.And Tenant's family and guests shall at all times maintain order in the Premises and at all places on the Premises, and shall not make or permit any loud or improper noises, or otherwise disturb other residents
10.Keep all radios, television sets, stereos, etc., turned down to a level of sound that does not annoy or interfere with other residents
11.Deposit all trash, garbage, rubbish or refuse in the locations provided therefore and shall not allow any trash, garbage, rubbish or refuse to be deposited or permitted to stand on the exterior of any building or within the common elements
12.Abide by and be bound by any and all rules and regulations affecting the Premises or the common area appurtenant to the property which may be adopted or promulgated by the Condominium or Homeowners' Association having control over them.


INSPECTION OF PREMISES
Landlord and Landlord's agents shall have the right at all reasonable times during the term of this Agreement and any renewal thereof to enter the Premises for the purpose of inspecting the Premises and all buildings and improvements thereon.  And for the purposes of making any repairs, additions or alterations as may be deemed appropriate by Landlord for the preservation of the Premises or the building.  Landlord and its agents shall further have the right to exhibit the Premises and to display the usual "for sale", "for rent" or "vacancy" signs on the Premises at any time within forty-five (45) days before the expiration of this Lease.   The right of entry shall likewise exist for the purpose of removing placards, signs, fixtures, alterations or additions, that do not conform to this Agreement or to any restrictions, rules or regulations affecting the Premises.

DAMAGE TO PREMISES
In the event the Premises are destroyed or rendered wholly uninhabitable by fire, storm, earthquake, or other casualty not caused by the negligence of Tenant, this Agreement shall terminate from such time except for the purpose of enforcing rights that may have then accrued hereunder.  The rental provided for herein shall then be accounted for by and between Landlord and Tenant up to the time of such injury or destruction of the Premises, Tenant paying rentals up to such date and Landlord refunding rentals collected beyond such date.  Should a portion of the Premises thereby be rendered uninhabitable, the Landlord shall have the option of either repairing such injured or damaged portion or terminating this Lease.  In the event that Landlord exercises its right to repair such uninhabitable portion, the rental shall abate in the proportion that the injured parts bears to the whole Premises, and such part so injured shall be restored by Landlord as speedily as practicable, after which the full rent shall recommence and the Agreement continue according to its terms.


SURRENDER OF PREMISES
Upon the expiration of the term hereof, Tenant shall surrender the Premises in as good a state and condition as they were at the commencement of this  Agreement, reasonable use and wear and tear thereof and damages by the elements excepted.

QUIET ENJOYMENT
Tenant, upon payment of all of the sums referred to herein as being payable by Tenant and Tenant's performance of all Tenant's agreements contained herein and Tenant's observance of all rules and regulations, shall and may peacefully and quietly have, hold and enjoy said Premises for the term hereof. 

INDEMNIFICATION 
Landlord shall not be liable for any damage or injury of or to the Tenant, Tenant's family, guests, invitees, agents or employees or to any person entering the Premises or the building of which the Premises are a part or to goods or equipment, or in the structure or equipment of the structure of which the Premises are a part, and Tenant hereby agrees to indemnify, defend and hold Landlord harmless from any and all claims or assertions of every kind and nature. 

ABANDONMENT
If at any time during the term of this Agreement Tenant abandons the Premises or any part thereof, Landlord may, at Landlord's option, obtain possession of the Premises in the manner provided by law, and without becoming liable to Tenant for damages or for any payment of any kind whatever.  Landlord may, at Landlord's discretion, as agent for Tenant, relet the Premises, or any part thereof, for the whole or any part thereof, for the whole or any part of the then unexpired term, and may receive and collect all rent payable by virtue of such reletting, and, at Landlord's option, hold Tenant liable for any difference between the rent that would have been payable under this Agreement during the balance of the unexpired term, if this Agreement had continued in force, and the net rent for such period realized by Landlord by means of such reletting.  If Landlord's right of reentry is exercised following abandonment of the Premises by Tenant, then Landlord shall consider any personal property belonging to Tenant and left on the Premises to also have been abandoned, in which case Landlord may dispose of all such personal property in any manner Landlord shall deem proper and Landlord is hereby relieved of all liability for doing so.

ATTORNEYS' FEES
Should it become necessary for Landlord to employ an attorney to enforce any of the conditions or covenants hereof, including the collection of rentals or gaining possession of the Premises, Tenant agrees to pay all expenses so incurred, including a reasonable attorneys' fee.

RECORDING OF AGREEMENT 
Tenant shall not record this Agreement on the Public Records of any public office.  In the event that Tenant shall record this Agreement, this Agreement shall, at Landlord's option, terminate immediately and Landlord shall be entitled to all rights and remedies that it has at law or in equity.

GOVERNING LAW
This Agreement shall be governed, construed and interpreted by, through and under the Laws of the State of Arizona.  

SEVERABILITY
If any provision of this Agreement or the application thereof shall, for any reason and to any extent, be invalid or unenforceable, neither the remainder of this Agreement nor the application of the provision to other persons, entities or circumstances shall be affected thereby, but instead shall be enforced to the maximum extent permitted by law.

BINDING EFFECT
The covenants, obligations and conditions herein contained shall be binding on and inure to the benefit of the heirs, legal representatives, and assigns of the parties hereto.

DESCRIPTIVE HEADINGS
The descriptive headings used herein are for convenience of reference only and they are not intended to have any effect whatsoever in determining the rights or obligations of the Landlord or Tenant.

CONSTRUCTION
The pronouns used herein shall include, where appropriate, either gender or both, singular and plural.

NON-WAIVER
No indulgence, waiver, election or non-election by Landlord under this Agreement shall affect Tenant's duties and liabilities hereunder.

MODIFICATION
The parties hereby agree that this document contains the entire agreement between the parties and this Agreement shall not be modified, changed, altered or amended in any way except through a written amendment signed by all of the parties hereto

NOTICE
Any notice required or permitted under this Lease or under state law shall be deemed sufficiently given or served if sent by United States certified mail, return receipt requested, addressed as follows:

DISCLAIMER
Tenants and Guests understand that the Homeowners and Homelink Professional Realty are NOT responsible for any personal injury caused by slipping on snow or ice, and that tenants are responsible for the removal of snow and ice around the doorways and paths to car, to include the parking area.  And further that the homeowners are not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul, inclement weather conditions, Acts of God or nature, failure of heat, accidents related to fire, heaters, stoves, tenants’ failure to remove snow around access areas, or any unforeseeable circumstances.  Under no circumstances will tenants or their guests hold the owners of Green Gable Cottage responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm.  This agreement and disclaimer applies to you and all guests within your party.

SAMPLE LEASE AGREEMENT

1.Check-In time is after 4:00 pm. (No early check-Ins)

2.Check-Out time is 10:00 am (No late check-outs).

3.No Smoking!  If there is evidence of smoking in the home, the home will be professionally cleaned by a special smoke removal service.  The cost will be deducted from the security/damage deposit.

4.Pets are not permitted in rental unit unless special arrangements have been made in writing.
 
5.We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent.

6.Deposit will be forfeited if damage is done to the house or its contents, beyond normal wear and tear.

7.Remove all debris, rubbish, and discards and place in dumpster prior to departure

8.Place soiled dishes in dishwasher and clean prior to departure

9.Start one load of laundry prior to departure

10.All keys must be left on the kitchen table and the house is left locked upon departure.

11.Entry Key must be returned to lock box!

12.Any charges accrued during the stay must be paid prior to departure.

13.Deposit will be forfeited if linens are lost or damaged.

14.Parking passes, garage door opener, gated entrance opener must be left on kitchen table upon departure.

15.We will not be liable for any personal items that are lost or damaged.

16.The maximum number of guests at the rental property is limited to a maximum of 6 (six) adults.  Additional arrangements may be made in writing for additional guests and additional fees may apply.

17.No daily maid service is provided
